1. Acceptance of Terms

By accessing or using the services provided by Fun in the Sun Events ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms apply to all visitors, users, and others who access or use our services.

2. Description of Services

Fun in the Sun Events provides event planning and coordination services for private individuals and small businesses in the Cape Coral and Fort Myers, Florida area. Our services include but are not limited to:

• Event concept development and planning
• Vendor coordination and management
• Day-of event coordination
• Post-event services and follow-up

3. Booking and Agreements

All event bookings are subject to a separate Event Agreement that will detail specific services, pricing, timelines, and other terms particular to your event. These Terms of Service operate in conjunction with any Event Agreement. In case of conflict, the Event Agreement shall prevail for matters specific to that event.

4. Payment Terms

Payment terms are established in individual Event Agreements. Generally:

• A non-refundable deposit is required to secure your event date
• Final payment is due as specified in your Event Agreement
• We accept major credit cards, checks, and electronic transfers

5. Cancellation Policy

Cancellation policies are determined on a per-event basis and detailed in your Event Agreement. Standard guidelines include:

• Cancellation more than 60 days before the event: Loss of deposit only
• Cancellation 30-60 days before the event: 50% of total contract value
• Cancellation less than 30 days before the event: 100% of total contract value

6. Limitation of Liability

To the fullest extent permitted by Florida law, Fun in the Sun Events shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services. Our total liability shall not exceed the total amount paid by you for services in the twelve (12) months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

7. Indemnification

You agree to defend, indemnify, and hold harmless Fun in the Sun Events and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.

8. Intellectual Property

All content, trademarks, and intellectual property on our website and in our materials are owned by or licensed to Fun in the Sun Events. You may not use, reproduce, or distribute any content without our prior written permission. Photos and videos taken at your event may be used by Fun in the Sun Events for promotional purposes unless otherwise agreed in writing.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Lee County, Florida, and you hereby consent to personal jurisdiction and venue in such courts.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on our website with an updated "Last Updated" date. Your continued use of our services after such modifications constitutes your acceptance of the revised Terms.
